Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Stuck app (“the App”) or visiting getstuck.app (“the Website”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not use the App or Website. We reserve the right to refuse service to anyone for any reason at any time.

2. Description of Service

Stuck is an iOS application that delivers a daily quote to your device. You can browse, like, save, and share quotes. The App also provides a home screen widget, push notifications, quote discovery, and the ability to submit your own quotes for review. The service is provided free of charge and may change or be discontinued at any time without notice.

3. Accounts

Some features require creating an account with a username, email address, and password. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must not create accounts using false information or impersonate others. You must be at least 13 years old to create an account.

You may delete your account at any time from within the App. Account deletion is processed as a soft delete. Your personal data (email, username) is scrubbed after 30 days. During this window you may reactivate by signing up again with the same email. We reserve the right to suspend or terminate any account that violates these Terms.

4. User-Submitted Content

You may submit quotes for inclusion in the App. By submitting content, you represent and warrant that you have the right to submit it and that it does not infringe on any third party's intellectual property or other rights. You grant Stuck a perpetual, worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, edit for formatting or moderation, use, display, publish, distribute, and share your submitted content in connection with the App, Website, marketing, and operation of the service.

You are solely responsible for the content you submit. Stuck does not endorse user-submitted content and assumes no liability for it. All submissions are reviewed before publication. We may reject, edit, or remove any submission at our sole discretion without notice or explanation. You may delete your own pending submissions at any time.

Do not submit quotes copied from books, songs, poems, articles, films, social media posts, quote websites, or other third-party sources unless you own the rights or have permission to grant us the license above. Publicly available content is not automatically free to use, and attribution alone does not grant permission.

5. Acceptable Use

You agree not to: reverse-engineer, decompile, or disassemble the App; exploit the API beyond normal usage or circumvent rate limits; submit content that is hateful, abusive, defamatory, obscene, or otherwise objectionable; use the App in any way that violates applicable laws or regulations; or attempt to gain unauthorized access to our systems or other users' accounts.

We enforce rate limits on all API endpoints and reserve the right to restrict or terminate access to accounts that abuse the service, without prior notice.

6. Intellectual Property

All design, code, branding, and original content in the App and Website are the property of Stuck and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the App without our prior written consent. Quotes displayed in the App are attributed to their respective authors where known.

Some quotes may be original to Stuck, user-submitted, AI-assisted, licensed, used with permission, or believed to be in the public domain or otherwise permitted by law. If you believe content in the App infringes your rights or is incorrectly attributed, contact us with enough information to identify the content and your claimed rights so we can review it and, where appropriate, remove or correct it.

7. Disclaimer of Warranties

THE APP AND WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY QUOTES OR CONTENT DISPLAYED IN THE APP, INCLUDING AUTHOR ATTRIBUTIONS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STUCK, AM MEDIA & DESIGN LLC (DBA AM MEDIA & DESIGN), AND THEIR OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE APP OR WEBSITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR TEN US DOLLARS ($10), WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless Stuck, AM Media & Design LLC (DBA AM Media & Design), and their operators, employees, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party, including intellectual property rights.

10. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the App shall be resolved exclusively in the state or federal courts located in Washtenaw County, Michigan. You waive any objection to the jurisdiction and venue of such courts.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes take effect immediately upon posting to this page. Continued use of the App after changes constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
